Restricted Access
TMaG restricts access and use of the Website to the following qualified individuals ("Users"):

• Full- and part-time employees and sales representatives of the adidas Group and its subsidiaries globally
• Corporate and full-time store employees of adidas retail stores
• Part-time store employees of adidas retail stores (working 20 -30 hours/week) following 60 days of service

Employees must be in good standing with their employer, i.e., not on a disciplinary status, etc.

Users must use the number of their adidas discount card (the identification card used to obtain discounts in adidas retail stores) or Reebok card number to access the Website. By providing such a discount card number, you represent and warrant that you are the authorized User of the corresponding discount card. Individuals without an adidas discount card must first work with their local Human Resources team to attempt to obtain an adidas discount card. As a last resort, potential users may complete a membership application. TMaG will attempt to verify employment, but membership applications will be approved at the sole discretion of TMaG.

Qualified individuals that have been approved must create a password and a User ID (to replace their adidas discount card number as their default User ID) to login to the Website. If you forget your user ID and/or password to the Website, you may have them emailed to you by following the "forgot password" link on the home page. If you forget your user ID and/or password to the Website and no longer have access to the email address you registered with us, Please contact us at 1.866.530.TMAG (8624) between 6 AM and 5 PM, Monday thru Friday. Beginning Saturday, April 19th, 2008 -- TaylorMade and adidas Golf Customer Service Departments will also be available on Saturday from 8 AM to 12 PM (All times Pacific.) or +1 760.476.5945 (outside the USA and Canada). We will provide you with your login ID and password after we verify your identity.

Your access to and use of the Website may be terminated at any time in TMaG’s sole discretion.

Resale Prohibited
This Website is intended solely for registered Users to purchase TaylorMade-adidas Golf products for personal use or for their family and friends. Products sold from the Website may not be resold as new or distributed to or through dealers. Violation of these terms will result in the loss of all employee purchase privileges and/or other disciplinary actions.

TMaG may track compliance with these restrictions by monitoring orders for unusual patterns. To ensure compliance, TMaG may track serial numbers and utilize other product identification methods.

Purchase Limits
TMaG limits calendar year purchases of TMaG products for the following groups of Users:

• Full- and part-time employees and sales representatives of the adidas Group and its subsidiaries globally
• Corporate and full-time store employees of adidas retail stores
• Part-time store employees of adidas retail stores (working 20 -30 hours/week) following 60 days of service

These restrictions apply to individual adidas discount cards and their corresponding tmagcompanystore.com User ID. Users may provide their tmagcompanystore.com User ID and password information to their family and friends, but all purchases made by any person using their tmagcompanystore.com User ID will apply against the purchase limits.

Each User is solely responsible for protecting his or her User ID. If a User loses his/her adidas discount card and/or tmagcompanystore.com login information, purchases made on tmagcompanystore.com by unauthorized individuals may count against the User’s annual purchase limits. Please contact us and your local Human Resources team immediately to report a lost discount card or compromised tmagcompanystore.com login information, so that we may turn off your access privileges and prevent unauthorized individuals from making purchases that apply against your annual purchase limits. If you receive a new adidas discount card number, please contact us with the new card number and we will reactivate your account with the new adidas discount card number.

Special Offers and Promotions
All prices shown on the Website are applicable solely for purchase by Users directly from TMaG through the Website. Special product or service offerings and promotions may be displayed from time to time on the Website and are considered discontinued and no longer valid once they are removed from the Website and/or as soon as the published expiration date for the offer/promotion expires. All offerings and promotions displayed on the Website are subject to change or cancellation at any time without notice.

If you have any questions about product appearance/specifications, please contact us before placing your order. The Website does not contain images of each offered item.

Sales Tax Policy
Sales tax may be added to each order, subject to federal, state, and local tax laws. We will do our best to accurately calculate sales tax, but errors may occur due to the large number of tax districts or other reasons. If we do not collect sales tax for your order, you may still be responsible for paying sales and use tax for the purchase, subject to state and local tax rules.

Order Acceptance/Confirmation

Paying for Your Order
You may pay for your order by MasterCard, Visa, or American Express credit card only. The accepted methods of payment may change at TMaG’s sole discretion.

Your credit card is charged upfront for your order. Should we not be able to ship your order complete, you will be charged only for the goods we have actually shipped along with any appropriate taxes or shipping and handling charges).

Order Cancellation and/or Modification
We may be unable to cancel or modify any purchase from the Website after a TMaG agent has processed your order or it has been released/sent to the warehouse until you receive your purchases and, if necessary, returned to us. Hence, you might not be able to modify your order after you click on the “Submit Order” button. If you are not completely satisfied with your purchases after receiving your order, please review our Return Policy. Orders for custom products may not be canceled or returned.

Return Policy
In order to keep the Website prices low, returns are not encouraged. Custom clubs may not be returned.

Unused product (except for custom clubs) may be returned. Returns will not be accepted without prior authorization and TMaG’s issuance of a Return Goods Authorization (RGA) number that must be written on the box. You are responsible for any freight charges required to return products. Upon receipt and verification of your return, we will issue a credit to your credit card account for product returned with a proper RGA number, less a 15% restocking fee with a minimum fee of $10.00. Individual bank policies will dictate when the net amount is credited to your account.

We strongly encourage you to use the helpful size charts on our Website to reduce the potential for a return on footwear and apparel and the resulting restocking fee.

In the event that we ship you the wrong product(s) compared to the receipt of your original order, you may return the product(s) without a restocking fee after obtaining an RGA number. Upon issuance of an RGA number, we will send you a pre-paid shipping label for returning the product(s), and once your return is received and verified, we will issue a credit to your credit card account for product returned with a proper RGA number. Individual bank policies will dictate when this amount is credited to your account.

All unauthorized returns of merchandise will be returned to sender and a credit will not be issued. TMaG is not responsible for merchandise returned with out a return authorization.

Order Processing
TMaG provides order fulfillment services. TMaG’s highest priority is to process normal orders for TMaG retailers before processing the deeply discounted employee orders.

Please allow 5-10 business days for order processing before shipping. Custom clubs may require an additional few days.

Shipping
All orders placed on this Website are subject to product availability and will be shipped F.O.B. our shipping facility. The risk of loss and title for ordered merchandise pass to you upon our delivery to the carrier. This means that product damaged in transit is the carrier’s responsibility and is an issue to be resolved between you and the carrier.

Should a carrier not meet its delivery performance requirements, i.e., next day air before 10:30am, this is an issue to be resolved between you and the carrier.

When your orders ships, you will be emailed a shipment tracking number, if the carrier supports that capability.

Shipping & Handling Costs
Shipping and handling costs per order from the Website depend in part upon the products and shipping methods chosen, and please note that shipping and handling costs for many items are quantity-, weight- and/or size-based. Here are the current shipping and handling costs charged on the Website per order:

Items sourced from and requested for pickup at the TMaG Global Headquarters building in Carlsbad, California USA will not be counted in the shipping and handling costs. This typically is only clubs. Most other items are sourced from other facilities in the United States and shipping and handling costs will be charged.

TMaG may change these rates at its sole discretion. If you have any questions about costs, please contact us.

Prohibited Activities
